Terms of Use

1. Agreement

These terms are an agreement between you and the operator of Mmory () (“Mmory”, “we”, “us”). By using the Mmory app or mmory.xyz you agree to them. If you do not agree, please do not use Mmory.

2. What Mmory is

Mmory lets you record short spoken or typed notes, finds them again when you ask, and can remind you about them. Transcription, search and answers run on your iPhone. Some features depend on your device, iOS version, language and Apple’s on-device capabilities, and may not be available to everyone.

3. Your memories live on your device

Mmory does not store your recordings, transcripts or memories on a server, so we cannot recover them for you. If you delete a memory, delete the app, lose or reset your iPhone, or restore from a backup that does not include them, they may be gone permanently. Original audio recordings are excluded from iPhone backups. You are responsible for your device, its passcode and its backups.

4. Accounts

An account is optional. If you create one, keep your sign-in details secure and tell us if you believe someone else has used your account. You can delete your account at any time in Settings → Account → Delete account. Deleting your account does not delete the memories on your iPhone, and does not cancel a subscription.

5. Mmory Pro

• Mmory is free to use within a monthly limit on saved audio memories. Mmory Pro raises that limit. Current limits and prices are shown in the app before you buy.
• Mmory Pro is offered as a monthly or yearly auto-renewing subscription, purchased through Apple’s App Store.
• Payment is charged to your Apple Account at confirmation of purchase.
• Renewal. The subscription renews automatically for the same period unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• Managing and cancelling. You manage or cancel your subscription in your Apple Account settings (Settings → your name → Subscriptions on iPhone). Deleting the app or your Mmory account does not cancel it.
• Refunds are handled by Apple under Apple’s policies; we cannot issue them. You can request one at reportaproblem.apple.com.
• Offers and trials, if any, are described in the app at the time, and convert to a paid subscription unless cancelled before they end.
• We may change prices or what Pro includes. Price changes for existing subscribers follow Apple’s rules and notice requirements.

6. Using Mmory responsibly

• Only record people where and how the law allows. In many places you need the consent of everyone being recorded. That responsibility is yours.
• Do not use Mmory to break the law, to infringe anyone’s rights, or to harm anyone.
• Do not attempt to reverse engineer, interfere with or circumvent the app, its limits or its purchase system, except where the law expressly allows it.

7. Answers can be wrong

Mmory uses speech recognition and AI that run on your iPhone. Transcripts can contain errors, answers can be incomplete or mistaken, and reminders depend on your device’s notification settings. Do not rely on Mmory for medical, legal, financial, safety-critical or emergency purposes, or for anything where a missed or wrong memory could cause harm.

8. Ownership

Your memories are yours. We claim no rights in what you record. The Mmory app, its design, name and artwork belong to us and our licensors, and we grant you a personal, non-transferable, revocable licence to use the app on Apple devices you own or control, as permitted by the App Store’s Usage Rules. Third-party components are credited in the app under Settings → Third-party notices.

9. Apple

These terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is not responsible for addressing claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. If the app fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, if any; to the maximum extent permitted by law Apple has no other warranty obligation. You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.

10. Disclaimers

Mmory is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not promise that Mmory will be uninterrupted, error-free, or that memories will never be lost.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, arising from your use of Mmory. Our total liability for any claim is limited to the amount you paid for Mmory Pro in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law, or any consumer rights you have that cannot be waived.

12. Changes and ending

We may update Mmory and these terms; if a change is significant we will tell you in the app or on this page. You can stop using Mmory at any time. We may suspend or end access to account or subscription features for serious or repeated breach of these terms. Because your memories are stored on your iPhone, ending your account does not remove them.

Governing law. These terms are governed by the laws of , without affecting any mandatory consumer protections where you live.
